Orange Customer Awarded Compensation For Poor Network Service

Mon, 23 Feb 2009

A mobile phone user has been awarded £500 by a UK court after suing his mobile operator for lack of network coverage .

According to a report in the Daily Telegraph, Londoner Tom Prescott took Orange to court after it refused to end his 18-month contract, despite him being unable to make or receive calls at his home or office in Richmond due to the poor reception.

Brentford County Court ruled that he was allowed to rescind his agreement with Orange and awarded him £500 in damages.

Speaking to the newspaper, he said: "As soon as I realised I could not get a signal, I tried to cancel it. But the phone network would not let me off the contract."

"Dealing with Orange was awful. I hope people who have the same problem now realise they can do something about it," the 32-year-old added.

Orange said in a statement that it was disappointed with court’s decision because its own records show Mr Prescott had "good use of his phone ".

It added: "The award granted to Dr Prescott was due to exceptional circumstances. The Brentford County Court judgement in no way sets a precedent as claims made in the small claims court are decided on a case-by-case basis. This case does not change the company’s liability for any future claims of this nature".

A spokesperson for Orange said that its GSM networks provide high quality coverage to 99 per cent of the UK population.

However, he added: "As with all mobile operators, it is worth noting that continuous network coverage cannot be guaranteed and network coverage can be affected by factors outside of our control. These points are acknowledged in our terms and conditions."
